1. Introduction
By using Parcel Right’s delivery services, you agree to the following terms and conditions. Please read them carefully.
2. Definitions
Carrier: Parcel Right Pty Ltd and its subcontractors trading under DAI Post no.1 Pty Ltd
Consignor: The sender of the goods.
Consignee: The recipient of the goods.
Goods: Items accepted for carriage by the Carrier.
Carrier’s Website: refers to www.parcelright.com.au, where further terms and conditions may be published.
3. Application of Conditions
3.1 These Conditions apply to all Services provided by the Carrier. All limitations of liability and indemnities remain in effect, regardless of any breach.
3.2 The Customer’s terms and conditions will not override these Conditions unless explicitly agreed in writing by the Carrier.
3.3 The Carrier may update these Conditions from time to time, and the Customer agrees to review the Carrier’s Website for updates.
4. Not a Common Carrier
4.1 The Carrier is not a common carrier and accepts no liability as such. The Carrier may refuse the carriage or transport of goods for any person or corporation and the carriage or transport of any class of goods is at the Carrier’s absolute discretion.
5. Performance of Services
5.1 The method(s) of undertaking the Services shall be at the sole discretion of the Carrier and the Customer hereby authorises the Carrier to adopt any method(s) other than any method which may have been instructed or agreed.
5.2 The Customer authorises any deviation from the usual route of carriage.
6. Scope of Service
Parcel Right provides last-mile delivery services within Australia, subject to these terms. We do not transport prohibited items, including hazardous materials or perishable goods. Please review our Freight Profile in Appendix A.
7. Customer Obligations
Customers must ensure all goods are securely packaged, properly labelled, and comply with all legal requirements. Failure to do so may result in refusal of service or liability for damages.
8. Carrier's Responsibilities
Parcel Right will handle, and transport goods with reasonable care. However, we reserve the right to refuse carriage if goods are improperly packaged or deemed unsafe.
9. Limitations of Liability
9.1 The Carrier is not liable for any loss or damage to the Goods unless caused by a direct and proven failure by the Carrier in the provision of its Services.
9.2 Parcel Right’s liability for loss or damage is limited to AUD 100 per shipment unless additional insurance is purchased.
10. Delivery Terms
Standard delivery times are estimated and not guaranteed. If the consignee is unavailable, goods may be left in a secure location or delivered to an alternative Collection Point location, and delivery will be deemed complete.
11. Responsibility for Charges
11.1 Payment Obligation
The Consignor is responsible for all charges related to the shipment, including but not limited to delivery fees, fuel surcharges, taxes, duties, and any additional charges incurred during transit. Payment must be made in accordance with the payment terms agreed upon at the time of booking.
11.2 Additional Charges
Parcel Right reserves the right to apply additional charges if:
The shipment's weight, dimensions, or contents differ from those declared at the time of booking.
Delivery is attempted outside standard service areas or during non-business hours at the request of the Consignor or Consignee.
The goods require special handling, storage, or are subject to regulatory or customs fees.
11.3 Refusal of Charges
If the Consignee refuses to pay any applicable charges upon delivery, the Consignor remains liable for those charges. In such cases, Parcel Right may, at its discretion, either hold the goods until payment is made or return the goods to the Consignor, with any additional costs incurred being the responsibility of the Consignor.
11.4 Non-Payment
In the event of non-payment, Parcel Right reserves the right to suspend services and take legal action to recover outstanding amounts, including but not limited to any legal fees, interest, and collection costs.
11.5 Billing Disputes
Any disputes regarding charges must be raised in writing within 14 days of the invoice date. Failure to dispute charges within this period will be considered acceptance of the charges.
11.6 Amendment of Charges
Parcel Right reserves the right to review and amend its charges at any time. Customers will be notified of any changes prior to their implementation, and continued use of our services will constitute acceptance of the revised charges.
12. Subcontractors
12.1 Right to Subcontract
Parcel Right reserves the right to engage subcontractors, agents, or third-party carriers to perform all or part of the services offered. This includes, but is not limited to, the transportation, handling, and delivery of goods.
12.2 Liability of Subcontractors
Any subcontractor engaged by Parcel Right will operate under the same terms and conditions as those outlined in this agreement. Parcel Right remains liable for the acts and omissions of its subcontractors as if they were acts and omissions of Parcel Right itself, except where otherwise provided by law.
12.3 Notification to Consignor
Parcel Right is not obligated to notify the Consignor of the engagement of a subcontractor. The use of a subcontractor does not alter the Consignor's obligations under these terms and conditions.
13. Lien
The Carrier retains a lien over all Goods for unpaid charges. If the Customer fails to settle any outstanding amounts, the Carrier may sell the Goods after providing notice to the Customer and apply the proceeds toward the outstanding debt.
14. Force Majeure
The Carrier will not be liable for any failure to perform the Services due to events beyond its control, including but not limited to natural disasters, strikes, governmental restrictions, or transport disruptions.
15. Claims Process
Claims for lost or damaged goods must be submitted in writing within 30 days of shipment date, accompanied by relevant documentation
16. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
17. Amendments
Parcel Right reserves the right to amend these terms at any time. Continued use of our services constitutes acceptance of the revised terms.
